just hours from now, u.c. regents will decide whether it will cost more to attend their schools next semester. >> here is a live look at the east bay, we'll talk about that. clouds are out there. it's still cool weather come next week. i'll have the forecast. i'm terry mcsweeney in for eric thomas. >> and i'm kristen sze. thanks for joining us. let's start with the traffic problem, a sinkhole on highway 87 could cause a headache for commuters this morning. >> so far it's getting by, right lane is closed. southbound 87 right at the virginia overcost crossing. it's a 30 by 30 sinkhole and road buckling has it closed between 280 and alma. emergency crews are hoping to have fixed by 12:00 noon.

alternate route would be almaden or byrd avenue from 280. traffic is getting by in one lane. no major problems so far but we'll follow it for you. >> cal state officials have done it and u.c. regents are going to do it. nick smith joins us from u.c. mission bay where the regents are meeting later this morning. >> reporter: if you look over my shoulder you can see those that are arriving are actually going through a mock security checkpoint of sorts. university of california bort board of regents is expected to approve a 9.6% increase and this inish to 8% to take effect in fall. it will cost u.c. students, $1900 more than last year and bring undergraduate tuition to just under $12,000 a year. that does not include room, board, books or campus fees.

all of that combined would be a $31,000 a year tuition for anyone attending the u.c. system. yesterday students addressing the regents at their meeting said families had not been given enough warning to come up with the additional money that would be $1068 the increase would require and they expressed particular concern for middle income students that were not eligible for financial aid. dozens of u.c. service workers and supporters held a vigil. they are asking to reconsider the raises and avoid balancing the budgets on the backs of working families and students. they proposed this increase to offset an extra $150 million cut in state lawmakers enacted when taxes failed to get republican vote. back here live, as you arrive you will have to go past the

barricades are that are in place. there should be a bit have a protest this morning. the board of rejechbts is meeting at 8:30. thanks a lot. las vegas police have arrested the girlfriend of giovanni ramirez the man suspected of beating bryan stow. they called 26-year-old woman a person of interest in the march beating of stow in the dodgers stadium parking lot. they were unable to locate her until she was arrested last week on trafficking methamphetamines. ramirez is spending 10 months in prison for violating his parole. brian is still in hospital. he opened his mouth on monday when a nurse told him she had to take his temperature. >> the full bart board will

review findings of the bart shooting death earlier this month. amy hollyfield is live the civic center with more on that and bart's new statement regarding protests? >> bart riders will be watching closely today. everyone we spoke to knows about the shooting and they want to hear more. some people were so upset about it, they held a protest earlier this week, one that shut down three stations in san francisco and they are promising there will be more demonstrations. bart is promising a jail tolerance policy saying the protestors will not be allowed to shut down stations anymore. this outrage is over over the death of charles hill who was armed with two knives. bart riders questioned whether he needed to be killed or whether to be subdued with a taser. they will be listening for answers today. >> i do sense there is a problem and definitely needs to be

addressed. confidence of bart, confidence of riding bart. i still feel comfortable at bart. i really do. its good system. one of the best in the nation. >> the shooting comes two and a half years of the shooting death of oscar grant. he was shot in the back by a bart police officer and grant was not armed. bart police have made some changes since the shooting but now there has been another one, they are questioning whether they were effective. there are four investigations going on and take some time to reach their conclusions but today, for the first time, we'll hear a report and that will come from bart's general manager. amy hollyfield, "abc 7 news." now to the jaycee dugard case, her kidnapping is raising serious questions about sex offenders and the way they are released from prison. under the current system, the

kidnapper philip garrido would not be classified as a high risk offender and because he was not molesting boys he would be considered a moderate risk based on ten factors in the system. >> he did not obtain enough points to say he was a severe person that someone may to it again. >> risk is too great to let somebody back in society and with somebody like him we shouldn't do it. >> using the current system he would be classified as a moderate risk he is now in prison for life, but this does affect when many other sex offenders are let out. >> the families of the seven fishermen of the boat that sank in the waters last month, they are asking for help. they want them to do more after the u.s. coastguard and mexican navy called off the search on

tuesday. some of the families are also trying to raise money for a private search if those efforts fail. yesterday friends and family paid their last respects to 63-year-old leslie yee, he is the only person confirmed death. in marin county a plan to build a glass enclosure in juvenile court. the idea is on to build a glass box with speakers and a microphone where all juvenile suspects would be seated. 15 defense letters have signed a letter of protest. some worry that it suggests guilt to a judge or to other in courtroom and treat them like animals. the plan may be a way to save money by eliminating a bailiff in the courtroom. >> time to talk about the weather and mike, more chances than we thought. something you said earlier the less numerous clouds this

around monterey, 64. low to mid-70s santa cruz gilroy and hollister. how about the accu-weather seven-day forecast, all seven days, at least half if if not two-thirds of it below average temperatures through sunday and then as we head through monday and wednesday, get a warming trend. good morning, sue, you have an update? >> we have a live shot. this is the sinkhole we've been reporting, buckling roads, guadalupe parkway, southbound 87 at the virginia overcrossing. its 30 by 30 foot sinkhole. crews are on the scene and trying to get it repaired they say by 12:00 noon today between 280 and alma ma the right lane is closed. the national route would be the almaden expressway or byrd avenue. just ahead, drastic measures

you are looking at live shot. guadalupe parkway. san jose southbound, big sinkhole. 30 by 30 sinkhole. emergency crews are trying to get it fixed. traffic is getting by in the left lane. they hope to have it fixed by noon. it's 6:15. one landlord is going through drastic measures to crack down on dog poop. a manager of apartments said she is so sick of tenants not cleaning up after pets she is hiring a dna testing service to find the culprits. she has to collect dna samples. they say owners who are caught will have to pay 60 for the cost of tests for future offenses. >> and reporters deal with all kinds of situations out in the field but there are some you can't prepare for.

we may see as much cloud cover as we're going to see today right now. let's talk about the temperatures. upper 40s around santa rosa and napa. that is when you know the clouds are few and far between. the rest of us in upper 50s around mountain view and san jose. cloudy around monterey bay, 52 in santa cruz to 51 in salinas then cooler than average temperatures thanks to a breeze coming off the ocean. mostly cloudy tonight. i think we'll see more drizzle than this morning and watching a warming trend that will roll into our forecast next weeks. for this morning, you see the clouds developing over the next twoum couple of hours and look how quickly they retreat out of east bay and south bay valleys, almost out of the bay by noon and back to the coast where they'll keep you in the 50s. 50s and 70s will dominate our weather once again today with temperatures pretty close to yesterday's, 73 in santa rosa.

we're also following breaking news in oakland where they are investigating the discovery of a burning body. jim huntington spoke with police just moments ago. jim, what can you tell us? >> right now, details are still very sketchy. this crime scene looks about two or three blocks northeast of the rockridge bart station. just east of college avenue. a relatively quiet neighborhood at this time of the day. police responded to a call of a person on fire at 4:46 a.m.. when they got there, i could see there was body in the middle of aivanhoe road. the body was covered up, we don't know the sex but it looked to be that of an adult. right now we can tell you, that ivanhoe road is cloud off between chabot road and miles

avenue. that is pretty busy down to rockridge bart station. so people are going to be hearing a lot of police cars, a lot of crime tape. we're waiting for the public information officer to show up, but it is clearly a crime scene in this quiet neighborhood of north oakland. right now there was a report of a person on fire when police and fire got here. it looked like the person was deceased. we know reporter amy hollyfield will be getting more information. >> all right. jim, thank you vice president of. talking about the discovery of a burning body in oakland this morning. significant development in the investigation on giants' fan bryan stow. a woman who was called a person of interest has been arrested in las vegas. 26-year-old woman has been

described as the girlfriend or ex-girlfriend of giovanni ramirez. the man that has been called at prime suspect in the beating of stow. investigators haven't been able to located her but she was arrested last week on meth charges. bryan stow is still recovering from severe brain injury. >> in san jose, members of a latino community they don't trust the police and are afraid to call authorities for help. they met with the police chief and told them about distress. many latinos are promising not to work with the police unless they get rid of two homeland security agents who work under the department of immigration. the chief says he needs community's help especially with 28 homicides this year. >> we have a community that is fearful of the police department many of them undocumented immigrants. we feel that this was step

backwards. >> immigration enforcement is not what we do and they are not associated with that. >> 15 nonprofit community action groups will talk about the next steps to take which includes possibly boycotting the police department. >> a marin county girl is fighting for her life after a rip tide swept her and two other teens out to sea. they lifted her from the rock near muir beach around 7:15 last night. the trouble started earlier when they were in a cove and wave swept them off the beach. two girls made it back to shore and taken to the hospital for evaluation. a good samaritan was also stuck in the rip tide. >> a body floating in a golf course pond.

a fisherman found it next to a golf course around 5:00 yesterday evening. coroner is yet to determine the cause of death. >> speculation is swirling in the east bay about walmart may be moving into new retail territory with plans to open two stand-alone grocery stores. pleasanton and hayward have received plans. in pleasanton, one document lists all mart and another one has listed an architecture work that has done work for walmart. it shows a pharmacy and cafe and bakery. there is going to be walmart grocery stores in other states but this would be the first for california if it does happen. >> the evidence seems to be there that it is going to be walmart. >> but walmart is not talking. >> mike is talking. >> mike is talking about a forecast, if you are not crazy about the mist and fog seems to be gone, less this morning and

>> take a look at temperatures in the east bay valleys, san ramon, low 70s and highway 4 corridor, warmest weather, pittsburg, brentwood, mid to upper 70s, same thing for fairfield. east bay shore, 64 in richmond and 68 in castro valley. farther south you will be warmer. 68 is as cold as we get in the south bay in sunnyvale. on the peninsula, 62 and breezy in millbrae but a little warmer from san mateo down into los altos with mid-70s in los altos. mid to upper 50s around the coast. best area for the fastest breezes. near 60s to low 60s in south san francisco and sausalito. low to mid-80s through the rest of the north bay valleys. we'll have the same low to mid-70s in gilroy and hollister. mid to upper 50s around watsonville and salinas with stubborn clouds.

you notice the green, the high elevation where we'll see drizzle along the coast and also in the east bay hills. 40s in santa rosa and cloverdale rest of us in low to mid-50s. area of low pressure is heading to the northeast. on the back side, jetstream is funneling the cool air in into our neighborhoods, seven-day forecast, while it has a minimal warming trend, still below average, when you see the temperatures hit 90 inland tuesday and wednesday, that is when we're back to average, 70s and 80s around the bay and low to mid-60s around the coast. we'll be 10-15 degrees cooler the next few days. >> going back to san jose, overnight we had the road buckle highway 87 at the virginia overcrossing at guadalupe parkway. emergency crews are trying to get that sinkhole repaired. this is between 280 and alma.

sensors are telling us about 10 miles an hour past the scene and hoping to have it wrapped by noon today. 205 approaching 580, possible lane blockages, slow traffic headed toward the livermore area. motorcycle down highway 4 at "a" street, traffic is getting by in the antioch area is much slower than that. we have a stall on the peninsula coming into san francisco, northbound 280, erramonte boulevard, traffic is getting by just fine there. >> we have more news, the number of adults who smoke in california are down to a record low. officials from the state tobacco control program says the smoking rate for adults has dropped to 11.9%. that a 50% decline when the taliban tax initiative went into effect 23 years ago. they put a 25 cent tax on every

road. >> there definitely is, seven-day forecast, looks like more cloud cover tomorrow and then that will drop our temperatures but how about the warming trend that will is coming into the forecast as we head into next week. the low that has been plaguing us with the consistently strong sea breezes. today they will be gusting to around 10-20 miles an hour and most areas, it will start to evaporate and then by monday, tuesday and wednesday, high pressure will move in. noticed the lack of clouds during the morning hours. that means the marine layer will be non-existent. once we hit the mid-80s and low 60s around the coast. that is where temperatures are close to average. we will warm into the 90s tuesday and wednesday, near 80 around the bay and mid-60s for the coast. still close to average. no big heat wave, just it will feel a lot different because it will 6-16 degrees warmer by next week.

problem spots still remains in san jose, southbound guadalupe, 87, emergency crews are trying to fix a big sinkhole. the road buckled right at the virginia overcrossing. our sensors is telling us about 15-20 miles an hour past the scene. road is open but in case i want to avoid that, alternate route would be almaden or byrd off-ramp. elsewhere we have an accident in antioch with motorcycle down. it is blocking the right lane. motorcycle and a truck and traffic is getting by the scene at about 33 miles an hour. still headed toward the concord area. toll plaza live shot it's backed up, still fastrak and carpool lanes will be best way to get around that. that is just past the west grand
